1. Acceptance of Terms

Your agreement with Disam Cleaning and Pest Control Services

Welcome to Disam Cleaning and Pest Control Services ("Disam," "we," "our," or "us"). By accessing our website, booking our services, or otherwise interacting with us, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

These Terms constitute a legally binding agreement between you and Disam Cleaning and Pest Control Services, a company registered in Kenya with its principal place of business in Nairobi, Kenya.

We may update these Terms from time to time. The most current version will always be posted on this page, and your continued use of our services constitutes acceptance of any changes.

2. Services Provided

What we offer

Disam provides professional cleaning and pest control services including but not limited to:

2.1 Cleaning & Disinfection Services

  • Sofa Cleaning & Disinfection: Deep cleaning and sanitizing of all sofa types
  • Mattress Cleaning & Disinfection: Removal of allergens, dust mites, and stains
  • Carpet Cleaning & Disinfection: Steam cleaning and stain removal

2.2 Deep Cleaning Services

  • Office Deep Cleaning: Comprehensive cleaning of professional workspaces
  • General House Deep Cleaning: Thorough cleaning of residential properties
  • Car Interior Deep Cleaning: Vacuuming, shampooing, and sanitizing vehicles

2.3 Specialized Services

  • Fumigation & Pest Control: Complete pest elimination for residential and commercial spaces
Service Areas: We currently operate in Nairobi, Mombasa, Kajiado, Machakos, Murang'a, Narok, Kiambu, and Nakuru counties. For areas outside these counties, we may offer services on a case-by-case basis with transport cost-sharing arrangements.

3. Booking and Payment

How to book and pay for services

3.1 Booking Methods

3.2 Pricing

All prices are quoted in Kenyan Shillings (KES) and include applicable taxes unless otherwise stated. Prices are subject to change without notice, but any changes will not affect confirmed bookings.

3.3 Payment Methods

We accept the following payment methods:

  • M-Pesa: Paybill number provided at booking
  • Bank Transfer: Direct deposit to our business account
  • Cash: Payment upon service completion

3.4 Payment Terms

Payment is due upon completion of services unless otherwise agreed. For commercial contracts, payment terms may be negotiated separately.

Late Payments: Accounts overdue by more than 30 days may be subject to interest charges of 2% per month and suspension of services until payment is received.

4. Cancellation Policy

Our cancellation and rescheduling terms

4.1 Client Cancellations

You may cancel or reschedule your booking as follows:

Less than 24 hours before appointment 50% of service fee
No-show (without notification) 100% of service fee

4.2 Disam Cancellations

In the unlikely event that we need to cancel your appointment due to unforeseen circumstances (e.g., staff illness, equipment failure, extreme weather), we will:

  • Notify you as soon as possible
  • Offer to reschedule at your convenience
  • Provide a 10% discount on your next booking

4.3 Refunds

Refunds for prepaid services will be processed within 5-7 business days to the original payment method.

5. Transport Cost-Sharing Policy

For clients outside Nairobi

For clients located outside our primary service area (Nairobi metro), we offer a transport cost-sharing arrangement to make our services accessible.

5.1 How It Works

The total transport cost is calculated based on distance from Nairobi. This cost is then shared between Disam and the client according to the following structure:

5.2 Multiple Bookings

If multiple clients in the same area book services on the same day, transport costs are shared among all bookings, significantly reducing individual costs.

5.3 Calculation

The exact transport cost will be calculated and communicated to you before booking confirmation. You have the right to decline the service if you do not agree with the transport cost-sharing amount.

6. Customer Responsibilities

Your obligations when using our services

To ensure the safety and effectiveness of our services, you agree to:

  • Provide Access: Ensure our team can access your property at the scheduled time. If access is not possible, cancellation fees may apply.
  • Secure Valuables: Remove or secure any fragile items, valuables, or personal belongings that could be damaged or interfere with cleaning.
  • Pet Safety: Secure pets in a safe area away from the work zone. We are not responsible for pet reactions to cleaning processes.
  • Inform Us: Disclose any specific issues such as stubborn stains, pest problems, or areas requiring special attention.
  • Safety Hazards: Inform us of any potential safety hazards (e.g., exposed wiring, unstable structures, hazardous materials).
  • Prepare for Pest Control: Follow all pre-fumigation instructions, including vacating premises if required and covering or removing food items.
Important: Failure to comply with these responsibilities may result in service delays, additional charges, or refusal of service. Disam is not liable for damages resulting from customer negligence.

7. Quality Guarantee

Our commitment to your satisfaction

We take pride in our work and stand behind the quality of our services.

7.1 Satisfaction Guarantee

If you are not completely satisfied with our cleaning service, please notify us within 24 hours of service completion. We will:

  • Return to address the issue at no additional cost, or
  • Provide a partial refund based on the extent of the issue

8. Limitation of Liability

Understanding our liability

8.1 Damage to Property

While we take every precaution to protect your property, accidents can occur. Our liability for damage to your property is limited to:

  • The cost of repair or replacement of the damaged item, up to a maximum of KES 50,000 per incident
  • For valuable items (antiques, artwork, electronics), please inform us in advance so special precautions can be taken

8.2 Exclusions

We are not liable for:

  • Damage resulting from pre-existing conditions not disclosed
  • Normal wear and tear
  • Damage caused by third parties
  • Indirect or consequential damages
  • Items of sentimental value (please secure these before service)

8.3 Insurance

Disam maintains comprehensive liability insurance. In the event of significant damage, claims will be handled through our insurance provider.

To file a claim: Report any damage within 24 hours of service completion with photos and a description. Claims reported after 24 hours may not be accepted.

9. Zero-Infestation Guarantee

Our promise for pest control services

For our pest control services, we offer a Zero-Infestation Guarantee:

  • 98% First-Visit Success Rate: We aim to eliminate the pest problem on the first visit.
  • Free Re-treatment: If pests return within the guarantee period (30-90 days depending on the pest type), we will re-treat at no additional cost.
  • Guarantee Periods:
    • General pests (cockroaches, ants, spiders): 30 days
    • Bed bugs: 60 days
    • Termites: 90 days
    • Rodents: 60 days
Conditions: The guarantee applies only to the specific pest treated and requires that you follow all post-treatment instructions (e.g., not cleaning treated areas for a specified period).

10. Safety and Eco-Friendly Policy

10.1 Eco-Friendly Products

We are committed to using environmentally responsible products:

  • 100% biodegradable cleaning agents (transitioning to 100% by end of fiscal year)
  • Non-toxic, hypoallergenic formulas safe for children and pets
  • Low-VOC products to maintain indoor air quality
  • EPA-approved pest control chemicals used only when necessary

10.2 Safety Precautions

Your safety is our priority:

  • All staff are trained in safe handling of cleaning chemicals
  • PPE (Personal Protective Equipment) is used at all times
  • For fumigation, we provide detailed safety instructions including re-entry times
  • We carry comprehensive liability insurance

10.3 Allergies and Sensitivities

If anyone in your household has severe allergies or chemical sensitivities, please inform us before service so we can adjust our products accordingly.

11. Intellectual Property

Ownership of content

All content on our website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Disam Cleaning and Pest Control Services and is protected by Kenyan and international copyright laws.

You may not:

  • Reproduce, distribute, or modify any content without our written permission
  • Use our trademarks or logos without prior consent
  • Copy or imitate our website design or structure

You may share our blog posts and social media content with proper attribution.

12. Termination

When services may be terminated

12.1 Termination by Client

You may terminate our services at any time by providing written notice. Any prepaid amounts for services not yet rendered will be refunded according to our cancellation policy.

12.2 Termination by Disam

We reserve the right to terminate or suspend services immediately if:

  • You violate these Terms
  • You fail to pay for services rendered
  • You provide false or misleading information
  • Your behavior is abusive, threatening, or harassing toward our staff
  • Site conditions pose a safety risk to our staff

In such cases, no refunds will be issued for services already performed, and you remain liable for payment of completed work.

13. Dispute Resolution

How we resolve disagreements

13.1 Informal Resolution

Before pursuing formal action, we encourage you to contact us directly to resolve any issues. Most disputes can be resolved through communication.

13.2 Mediation

If we cannot resolve a dispute informally, both parties agree to attempt mediation through a mutually agreed-upon mediator in Nairobi, Kenya, before pursuing arbitration or litigation.

13.3 Arbitration

Any dispute not resolved through mediation shall be resolved by binding arbitration in accordance with the rules of the Chartered Institute of Arbitrators (Kenya Branch).

13.4 Small Claims

Disputes involving amounts under KES 100,000 may be filed in small claims court rather than arbitration.

14. Governing Law

Legal jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any legal actions or proceedings relating to these Terms shall be brought exclusively in the courts of Nairobi, Kenya, and you consent to the jurisdiction of such courts.

15. Changes to These Terms

When and how we update terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or operational needs. We will notify you of any material changes by:

  • Posting the new Terms on this page with an updated "Last Updated" date
  • Sending an email notification (if we have your email address)
  • Displaying a notice on our website

Your continued use of our services after changes constitutes acceptance of the updated Terms.
